§ 1 Users

The user of these Terms and Conditions is considered to be:

§ 2 Scope

These Terms and Conditions apply to all legal transactions between the user and a consumer (pursuant to Section 13 of the Civil Code of a natural person entering into a legal transaction for purposes which are predominantly neither commercial nor applicable self-employment).

§ 3 Conclusion of the contract and saving of contract text

The terms and conditions apply to orders that consumers complete through the website www.weinhof-platzer.at.

The contract is concluded with the user (see § 1).

The presentation and description of the goods on the website www.weinhof-platzer.at does not constitute a contractual offer.

By ordering a product by clicking on the "Submit Order" button at the end of the ordering process, a consumer makes a binding offer on a purchase agreement. It is only after the user sends an order confirmation by e-mail that the contract is concluded.

The text of the contract is stored on orders. Consumers receive an email with the order data. After the conclusion of the contract, the order data can no longer be viewed online.

§ 4 Payment

The statutory sales tax as well as other price components are included in the prices quoted. Shipping costs are not included in the quoted price and may also apply.

Consumers have the following payment options at their disposal:

• Credit card / Debit card
• Sofort
• Invoice (bank transfer)

§ 5 Delivery and supply restrictions

Delivery is to be completed within 14 working days – provided that the description of a selected product does not explicitly specify otherwise.

This period begins, in the event of payment via bank transfer, the day after the payment order has been issued.

§ 6 Right of revocation

You have the right to cancel your purchase contract within fourteen days without giving any reason. The cancellation period starts on the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

by means of a clear statement (e.g. a letter sent by post or by e-mail) of your decision to withdraw from this contract. In order to meet the cancellation deadline, it is sufficient for you to send your notification that you are exercising your right of cancellation before the cancellation period has expired.

§ 7 Consequences of revocation

If you withdraw from your purchase contract, we will have to pay you back all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the standard delivery offered by us) immediately and at the latest within fourteen days from the day on which we received notification of your withdrawal from the contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was explicitly arranged with you; In no case will you be charged any fees for this repayment.

We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of your contract. The deadline is met if you send the goods before the period of fourteen days has expired. We bear the costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to any handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

§ 8 Exclusion of the right of revocation

The right of withdrawal does not apply to goods delivered that are unsuitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery.

§ 9 Transfer of risk

The risk of accidental deterioration or coincidental loss of the goods lies with the user until the goods are handed over to the consumer, who thereafter takes over this risk.

§ 10 Reservation of ownership

Until the purchase price is received in full, the user reserves ownership of the goods.

§ 11 Guarantee

Statutory warranty regulations apply.
